Prosecutors told the court that the new clothing included long pants specifically chosen to conceal a rifle tucked down his trousers.

Prosecution’s Case

Over a five-day preliminary hearing held in July, the state laid out what it described as a comprehensive evidentiary record establishing probable cause for trial. Key elements included DNA evidence linking Robinson to the murder weapon and to other items recovered at the scene, including a towel wrapped around the rifle and a screwdriver. Prosecutors also pointed to alleged confessions Robinson made to close acquaintances and to a recorded video statement from his roommate and romantic partner, Lance Twiggs.

On Tuesday, prosecutor Ryan McBride addressed the court with what he characterized as an overwhelming body of proof.

“There is a mountain of evidence that proves that he is the shooter,” McBride told the court, referencing video footage he said depicted Robinson “dressed to kill” on campus the day of the shooting. “We know that the defendant is the shooter… first, because of the video evidence; second, because of the DNA; third, because of his admissions; and fourth, because of circumstantial evidence.”

McBride further noted that engravings discovered on shell casings recovered from the scene provided additional forensic linkage. Prosecutors also presented evidence that Robinson’s DNA was found on his grandfather’s rifle, which had been stashed in a wooded area near the campus after the shooting.

Motive and Aggravating Factors

The state’s theory of motive centers on Robinson’s personal animus toward Kirk’s conservative positions, particularly his views on transgender issues, which prosecutors described as being regarded by the defendant as “repugnant.” Robinson was said to have been in a romantic relationship with his roommate at the time.

Prosecutor Chad Grunander framed the shooting as a deliberate act of calculated risk against bystanders.

“He was playing, in effect, a game of ballistic roulette,” Grunander said, accusing the defendant of “gambling with the lives of others” when he allegedly fired toward Kirk while the commentator was surrounded by attendees. “It’s been 356 days since Tyler Robinson assassinated Charlie Kirk,” Grunander added. “It’s time for him, the defendant, to be bound over for trial and arraigned. Defence Strategy and Procedural Disputes

Robinson’s legal team spent the July hearing challenging procedural matters and questioning the qualifications of expert witnesses called by the state. They have also repeatedly objected to cameras livestreaming the proceedings, a point Judge Graf revisited during a sealed session on Tuesday morning before closing arguments commenced. The judge ultimately sided with transparency, a decision notable given the volume of public speculation surrounding the case.

On the merits of the aggravating-factors argument, the defence maintained that because no bullet struck anyone other than Kirk, the capital charge should be severed. The court did not accept that position.

Family Reaction

Kirk’s widow, Erika, mother of their two children, sat in the gallery alongside his parents, Robert and Kathryn. Robinson, dressed in a grey suit and periodically conferring with his attorneys, appeared before the bench in Provo. After the hearing concluded, the Kirk family issued a statement describing the judge’s decision as marking “an important step” in their “pursuit of justice.”

“Every step in this process carries the weight of all that Charlie’s murder has taken from his family, especially his children who will grow up without their father,” the statement read.
